Waiver of Liability, Assumption of Risk, and Indemnity Agreement

We strongly recommend that you consult with your doctor before beginning any yoga, movement, exercise or dance activities carried out in a Qoya session, retreat or event.

Kate Taylor T/AKate Taylor Creative Living is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition.

You should understand that when participating in any exercise, movement or dance sessions as an online event with Kate Taylor T/A Kate Taylor Creative Living there is the possibility of physical injury. If you engage in these online sessions, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself or others.

You must ensure that you have enough room to participate in the activity without there being any obvious risk of injury to themselves, to others, or risk of any damage to surrounding property.

Waiver of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of the services and equipment provided by Kate Taylor | Creative Living its directors, employees, agents, volunteers, participants and all other persons or entities associated with or acting in any capacity on its behalf at a retreat or workshop organised by Kate Taylor T/A Kate Taylor Creative Living in the United Kingdom or abroad (collectively, the “Events”), I hereby agree in this Acknowledgment and Assumption of Risk, Release and Indemnification (“Agreement”) to release, indemnify and discharge Kate Taylor T/A Kate Taylor Creative Living (“Organiser”) , on behalf of myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children, as follows: 

I, for myself, my heirs, personal representatives or assigns, do hereby forever release, waive, discharge, and covenant not to sue the Organiser or their employees or agents and release them from liability from any and all claims resulting in personal injury, accidents or illnesses (including death), other than through negligence -  and property loss (including theft) arising from, but not limited to, participation in activities, observation, and use of facilities, premises, transport or equipment, and with regard to advice, recommendations and programs relating to or in connection with my involvement in the Event. 

ATTENDEE AGREEMENTS

I am over 18, in good health, and am physically and mentally capable of handling any proposed activities. 

If an activity is proposed for which I do not feel physically or mentally prepared, I will notify the Organiser and will voluntarily not undertake that activity. While the Organiser will endeavour to adhere to the proposed schedule and services, should they deem it necessary to make changes, I agree that they have the final word and authority.

I am responsible for my own actions. 

I agree and understand that Kate Taylor Creative Living and its employees, contractors, agents, and owners, including Kate Taylor or Catriona Taylor as an individual (collectively, "Company") assume no responsibility for me and that my participation in the Event is purely voluntary and at my sole discretion. 

I am also aware of the potential stress, physical, and mental requirements, and I fully assume all responsibility of my own wellbeing and actions, both physically and mentally.

I am responsible if I do something disruptive or illegal. 

Any person who appears intoxicated or otherwise disruptive to the conduct of a class or activity may, at the sole discretion of Kate Taylor T/A Kate Taylor Creative Living be asked not to participate.  Participants will be totally responsible for any financial or physical damages incurred due to their actions, whether intentional or not.

Intellectual Property:  

I will not steal content of Kate Taylor T/A Kate Taylor Creative Living I understand and agree that all documents, ideas, scenarios, workbooks, movements, dance steps, routines and choreography and all other materials presented at the Event ("Materials") are the confidential and proprietary property of Kate Taylor | Creative Living and that I have only a limited right to use the Materials for my own personal use and purposes. Under no circumstances will I disclose these Materials to any other party or utilise them in any other manner, either for business or research purposes, without the prior written agreement of Kate Taylor | Creative Living. I understand and agree that any such use would be an infringement on Kate Taylor T/A Kate Taylor Creative Living 's intellectual property rights, for which there are civil and criminal penalties. 

I am participating in the Event of my own free will and not as an employee Kate Taylor Creative Living. Accordingly, I understand that I may not make a Worker's Compensation claim as a result of injury suffered (if any) related to the activity.

Indemnification and Hold Harmless: 

I also agree to INDEMNIFY AND HOLD HARMLESS the owners of any premises from which the Event is conducted from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including legal fees brought as a result of my involvement at in the Event and to reimburse them for any such expenses incurred.

Arbitration: 

Any dispute arising out of or in connection with this agreement shall be referred to and finally resolved by arbitration under the LCIA Rules, which Rules are deemed to be incorporated by reference into this clause.

Severability: 

The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by United Kingdom law and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgment of Understanding: 

I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
